The terms that apply to purchases and use of the JZShrimps website.
These Terms & Conditions govern access to and use of the JZShrimps website and all purchases made through it. JZShrimps is an Ontario-based aquarium business offering live shrimp, aquatic plants, botanicals, aquarium products, and related supplies. If you do not agree to these terms, do not use the website or place an order.
These terms form part of the agreement between you and JZShrimps for each order. If there is a conflict between these terms and a specific written agreement issued by JZShrimps, the specific written agreement controls only to the extent expressly stated.
Product descriptions, photographs, sizes, colours, grades, quantities, availability and prices are provided in good faith and may change without notice. Natural variation is expected in live shrimp, aquatic plants, botanicals, wood, stone and other natural products. Photographs are illustrative unless expressly stated otherwise. Exact colour, pattern, size, sex, grade, shape or appearance is not guaranteed unless specifically confirmed in writing.
Live livestock availability is subject to change because animals are living organisms. An order is not accepted or confirmed until payment and availability have been reviewed and accepted by JZShrimps. JZShrimps may substitute, delay, limit or cancel an order where a product is unavailable, unsafe to ship, damaged, unsuitable, or affected by an obvious listing error.
Prices are shown in Canadian dollars unless otherwise stated. Applicable taxes, shipping charges and other disclosed fees may be added at checkout. Payment may be processed through Square or another third-party payment provider. You authorize JZShrimps and its payment processor to charge the payment method supplied for the full amount authorized at checkout.
JZShrimps may correct pricing, description, inventory or listing errors and may cancel an order affected by an obvious error, subject to applicable law. A payment authorization, order confirmation, or automated email does not necessarily mean that JZShrimps has accepted or fulfilled the order.
Submitting an order is an offer to purchase the selected products. JZShrimps may accept, decline, limit, suspend or cancel an order for reasons including availability, payment issues, suspected fraud, chargeback risk, shipping restrictions, weather, unsafe conditions, incorrect information, or listing errors.
Customers are responsible for reviewing items, quantities, address, email, telephone number, shipping method and total before completing checkout. Customers must provide accurate and complete information and promptly notify JZShrimps of any error. JZShrimps is not responsible for delays, loss, failed delivery, additional charges or livestock loss caused by incorrect or incomplete information supplied by the customer.
Live shrimp are sensitive animals and are purchased at the customer's risk after delivery and acceptance, except for an approved eligible DOA claim or any rights that cannot legally be excluded. Customers are solely responsible for ensuring that their aquarium is fully cycled, appropriately maintained, and suitable for the livestock ordered, including suitable temperature, water chemistry, filtration, acclimation and tankmates.
JZShrimps does not guarantee survival after the livestock has been accepted, after the shipping bags have been opened, or where loss results from unsuitable water parameters, temperature, acclimation, tank conditions, mishandling, delayed opening, improper care, aggression, disease introduced by another source, or any circumstance outside JZShrimps' reasonable control. Mixing new livestock with an established aquarium is done at the customer's own risk.
Eligible DOA claims must be submitted within 1 hour of the first delivery attempt or delivery notification, whichever occurs first or is applicable. The customer must keep the shipping bags completely unopened until the entire unboxing has been continuously recorded.
The customer must provide:
Claims without a complete unboxing video, claims submitted after the deadline, claims involving opened bags before recording, edited or incomplete footage, missing evidence, or failure to follow instructions may be denied. JZShrimps may request additional evidence and may determine whether a claim is eligible based on the information provided.
For an approved eligible DOA claim, JZShrimps may provide store credit or a replacement, at JZShrimps' discretion and subject to livestock availability. Cash refunds are not guaranteed under this DOA policy. Store credit, replacement livestock, shipping charges and any other remedy will be limited to what JZShrimps expressly approves in writing, subject always to rights that cannot legally be excluded or limited.
Shipping is subject to the destination, selected shipping method, carrier rules, weather, service availability and the Shipping Policy. Carrier delivery estimates are estimates only and are not guarantees. JZShrimps may delay shipment when weather, temperatures, carrier disruptions or other conditions create an unreasonable risk to live livestock or products.
Customers must monitor tracking and be available to receive shipments promptly. Customer-requested holds, reroutes, delivery changes, missed delivery attempts, incorrect addresses, refusal of delivery, failure to retrieve a package, or failure to follow carrier instructions may void live-arrival coverage and may result in additional shipping charges. Customers must not open, leave unattended, expose to extreme temperatures, or otherwise mishandle a shipment.
Once a package has been handed to the carrier, JZShrimps is not responsible for carrier delays, mishandling, theft after delivery, incorrect delivery information, or other circumstances outside JZShrimps' reasonable control, except where liability cannot legally be excluded. Customers must still comply with the DOA claim requirements if livestock arrives deceased.
JZShrimps may postpone, reroute or cancel shipment during extreme heat, cold, storms, natural disasters, carrier disruptions, transportation interruptions, government restrictions, illness, equipment failure, or other unsafe or unforeseeable conditions. Customers may be contacted to arrange a safer shipment date.
A customer-requested delay, hold, reroute or delivery change is undertaken at the customer's risk unless JZShrimps confirms otherwise in writing. JZShrimps is not responsible for failure or delay caused by circumstances beyond its reasonable control.
Returns, refunds, cancellations and replacements are subject to the applicable product terms and the Returns & DOA Policy. Live livestock, aquatic plants and other perishable, live, opened, used, specially prepared or specially ordered products may be non-returnable except where required by law or expressly approved by JZShrimps.
Cancellation requests must be made as soon as possible. An order that has been packed, shipped, collected, specially prepared, or purchased specifically for the customer may not be cancellable. Approved refunds, credits or replacements may be reduced by non-refundable costs where permitted by law. A customer may not cancel, reverse or dispute a legitimate payment merely because the customer changed their mind or failed to follow these terms.
Local pickup is available only at the location and during the time confirmed by JZShrimps. Customers must bring the order confirmation and may be required to provide valid government-issued identification and/or proof of payment.
For high-value, unusual or higher-risk orders, JZShrimps may require pickup at a secure location, require identification, verify billing and payment information, confirm the identity of the purchaser, require an authorized-person confirmation, or apply additional security procedures before releasing the order. Orders will only be released to the purchaser or an authorized person approved by JZShrimps.
Customers are responsible for collecting orders within the agreed pickup window. Unclaimed or repeatedly missed pickup orders may be subject to storage, rescheduling, cancellation or other reasonable charges where disclosed and permitted by law. Risk in products transfers to the customer upon pickup or release, except where otherwise required by law.
JZShrimps may request additional verification for unusual, high-value, or potentially fraudulent orders. This may include identification, confirmation of billing information, proof of payment, matching the purchaser's name to the payment method, or confirmation from the payment provider. JZShrimps may hold, decline, cancel or refund an order where verification cannot be completed.
Customers agree not to submit a false, misleading or improper payment dispute or chargeback. If a payment dispute is opened, JZShrimps may provide the payment processor with relevant order, delivery, pickup, communication and verification records. This does not limit any lawful right to dispute a transaction.
Website text, photographs, graphics, branding, logos, product descriptions and other content are owned by or licensed to JZShrimps unless otherwise stated. You may not reproduce, copy, modify, distribute, scrape or use this content commercially without written permission.
The website may link to or use third-party services such as payment processors, carriers, hosting providers and social platforms. Those services have their own terms and policies. JZShrimps is not responsible for third-party systems outside its reasonable control, including outages, processing delays, carrier disruptions, account restrictions or service interruptions.
To the maximum extent permitted by applicable law, JZShrimps is not liable for indirect, incidental, consequential, exemplary or special losses arising from an order, shipment, livestock loss, website use, carrier delay, customer error, or third-party service. To the extent permitted by law, any liability of JZShrimps relating to an order will not exceed the amount actually paid to JZShrimps for the specific product or order giving rise to the claim.
Nothing in these terms excludes, restricts or waives any consumer right, statutory warranty, remedy, or other legal protection that cannot lawfully be excluded, restricted or waived.
Personal information is handled in accordance with the JZShrimps Privacy Policy. Information may be shared with service providers where reasonably necessary to process payments, fulfill orders, arrange shipping, prevent fraud, verify identity, or provide customer support.
These terms and any purchase are governed by the laws of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles. Subject to any mandatory consumer rights or jurisdictional rules, disputes will be addressed in the courts of Ontario having appropriate jurisdiction.
If any provision of these terms is found invalid, illegal or unenforceable, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure by JZShrimps to enforce a provision is not a waiver of its right to enforce it later. These terms, together with the applicable order details and linked policies, constitute the agreement relating to the purchase, subject to any mandatory legal requirements.
JZShrimps may update these terms as the business, website, products or legal requirements change. The current version will be posted on this page. Changes generally apply to future orders and website use unless otherwise required by law.
